MINOR PARTICIPANT ACKNOWLEDGMENT OF RISK, PARENTAL CONSENT, RELEASE & EMERGENCY MEDICAL AUTHORIZATION

ONE FORM IS REQUIRED FOR EACH PARTICIPATING CHILD.

ACTIVITIES COVERED

I give permission for the minor child identified above ("Participant") to attend and participate in Full Throttle Race Day, including, as applicable:

  • Participant-owned 12V or 24V ride-on vehicles

  • Event-provided electric go-karts for drag racing

  • RC car racing and related staging/course activities

  • Carnival games and recreational activities

  • Games involving balls, throwing, running and physical activity

  • Food, drink, entertainment and general event activities

  • Being present in spectator, staging, registration, parking and event areas.

Participation in individual activities may be restricted based on age, size, equipment, safety requirements or the judgment of event officials.

1. ACKNOWLEDGMENT OF RISKS

I understand that the activities at Full Throttle Race Day involve inherent and other risks that cannot be completely eliminated, even when reasonable safety precautions are used.

These risks include, but are not limited to:

  • Collisions with other vehicles, participants, barriers, objects or structures;

  • Loss of control of a ride-on vehicle or go-kart;

  • Sudden starts, stops or changes in direction;

  • Vehicle tipping or overturning;

  • Falls from vehicles or while running, playing or participating in games;

  • Impact from RC cars, balls, game equipment or other objects;

  • Contact with other participants, spectators, volunteers or event equipment;

  • Cuts, scrapes, bruises, sprains, strains and broken bones;

  • Head, neck, dental or other bodily injuries;

  • Injuries associated with helmets or protective equipment that may not prevent all injuries;

  • Battery, electrical, charging or mechanical equipment hazards;

  • Equipment malfunction or failure;

  • Uneven pavement, grass, curbs, temporary barriers, cones, cords and other surface conditions;

  • Slips, trips and falls;

  • Heat, sun exposure, dehydration, rain, wind and other weather conditions;

  • Allergic reactions or food-related risks;

  • Risks associated with inflatable attractions and carnival games;

  • Actions or mistakes of the Participant, other children, spectators or third parties; and

  • Other risks that may be foreseeable or unforeseeable in connection with an active outdoor motorsports-style event.

I understand that serious bodily injury, permanent disability or, in extremely rare circumstances, death can result from recreational and motorized activities.

I have had an opportunity to consider these risks before allowing my child to participate.

2. VOLUNTARY PARTICIPATION AND ASSUMPTION OF INHERENT RISKS

I voluntarily choose to allow my child to participate.

On behalf of myself, I knowingly accept and assume the inherent risks associated with my child's participation and presence at the event, including the risks specifically described above.

I understand that signing this document does not mean that all injuries are preventable or that the event organizers guarantee my child's safety.

3. PARENT RESPONSIBILITY AND SUPERVISION

I understand that Full Throttle Race Day is not a childcare program.

I agree that a parent, legal guardian or responsible adult designated by me will remain responsible for supervising my child during the event except while the Participant is under the immediate direction of race officials during an organized race or activity.

I am responsible for determining whether my child is physically, emotionally and developmentally capable of participating safely.

I agree that my child will not participate if the child is ill, injured or otherwise unable to safely participate.

4. SAFETY RULES

I agree that my child will:

  • Follow all instructions from event officials and volunteers;

  • Remain within designated racing and activity areas;

  • Follow starting, stopping and course instructions;

  • All riders must arrive with their own helmet and wear a properly fitted helmet whenever required;

  • Use seat belts, restraints or other safety equipment when provided or required;

  • Not intentionally bump, ram or interfere with another participant;

  • Immediately stop when directed by an event official; and

  • Conduct themselves in a manner intended to protect their own safety and the safety of others.

I understand that event officials may delay, modify, restrict or end my child's participation at any time for safety reasons, without regard to race standing or registration fees.

5. PARTICIPANT-OWNED RIDE-ON VEHICLES

If my child participates in the Ages 4–6 Bring Your Own Race Car division, I understand that I am responsible for the condition and suitability of the vehicle I provide.

I represent that, to the best of my knowledge:

  • The vehicle is age-appropriate for my child;

  • The steering and braking/stopping systems function properly;

  • The wheels and body are secure;

  • The battery and wiring do not have known defects;

  • The vehicle has not been modified in a manner that I believe makes it unsafe;

  • My child has previously operated the vehicle or is capable of operating it safely; and

  • I will disclose any unusual modifications or performance enhancements to race officials.

Any safety review performed by event staff is only a basic event safety check and is not a mechanical inspection, certification or warranty that the vehicle is safe or free from defects.

6. EVENT-PROVIDED GO-KARTS

If my child uses an event-provided go-kart, I understand that:

  • The Participant must use the vehicle assigned by race officials;

  • Required helmets and safety equipment must be worn and brought by each rider;

  • The Participant must follow all instructions concerning operation, speed, starting and stopping;

  • The Participant may not intentionally collide with another vehicle;

  • The Participant must stop immediately when instructed; and

  • Event officials may determine that a Participant should not operate a vehicle because of size, fit, behavior, ability or another safety consideration.

7. RELEASE OF CLAIMS TO THE EXTENT PERMITTED BY LAW

To the fullest extent permitted by the laws of the Commonwealth of Virginia, I, individually and as parent or legal guardian of the Participant, release and agree not to assert claims against:

GRIT Baseball; Divergent Performance; the property owner; event organizers; coaches; officers; directors; members; employees; volunteers; officials; sponsors; vendors; contractors; equipment providers; and their respective representatives

("Event Parties")

for injuries, losses or damages resulting from:

  • Risks inherent in the activities;

  • The Participant's own acts or omissions;

  • The acts or omissions of other participants or third parties; or

  • Other claims that may lawfully be released or waived under Virginia law.

Nothing in this document is intended to waive or release a claim that cannot legally be waived or released under Virginia law.

8. PROPERTY DAMAGE

I accept responsibility, to the extent permitted by law, for property damage intentionally or recklessly caused by my child.

I understand that GRIT Baseball, Divergent Performance and the Event Parties are not responsible for loss of or damage to personal property brought to the event, including ride-on vehicles, RC cars, batteries, chargers, phones, clothing or other personal items, except to the extent otherwise required by law.

9. EMERGENCY MEDICAL AUTHORIZATION

If my child becomes injured or ill during the event, I authorize event staff to:

  • Provide reasonable basic first aid;

  • Contact 911 or emergency medical personnel when reasonably believed necessary;

  • Arrange emergency transportation when reasonably believed necessary; and

  • Provide emergency responders with the medical and emergency-contact information contained on this form.

If I cannot be reached promptly in an emergency, I authorize licensed emergency medical and health care professionals to provide treatment they determine is reasonably necessary for my child's health and safety, subject to applicable law.

I understand that I am responsible for medical expenses incurred on behalf of my child that are not otherwise covered by insurance or another responsible party.

10. AUTHORITY TO SIGN

I represent that I am the Participant's parent or legal guardian and have legal authority to give permission for the Participant to participate and to sign this document.

I certify that the information I have provided is accurate to the best of my knowledge.

11. ACKNOWLEDGMENT

PLEASE READ BEFORE SIGNING

I acknowledge that:

  • I have read this entire document;

  • I understand that Full Throttle Race Day includes motorized and physical recreational activities that involve a risk of injury;

  • The risks of participation have been disclosed to me;

  • I have had the opportunity to ask questions before allowing my child to participate;

  • My child's participation is voluntary;

  • I agree to the safety and supervision requirements contained in this document; and

  • I understand that this document contains legal terms concerning assumption of risk and the release of certain claims to the fullest extent allowed by Virginia law.
